Welcome to Misfit Country Dancing ("Misfit," "we," "us," or "our"). These Terms of Use ("Terms") govern your use of misfitcountrydancing.com (the "Site") and your participation in our classes, socials, competitions, and other events (together, the "Services"). By using the Site, creating an account, RSVPing, or attending a Misfit event, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Services.
Accounts and payments are provided by GNetwork. Your Misfit Country Dancing login is a GNetwork account, and all payments, subscriptions, saved payment methods, and billing are processed through GNetwork. For anything related to your GNetwork account or payments, the GNetwork Terms of Use (gnetworkclub.com/terms) apply and control over this page.
The Services are intended only for adults. You must be at least 18 years old to create an account, RSVP, purchase tickets or memberships, or attend Misfit events.
Misfit Country Dancing uses GNetwork to provide user accounts, sign-in, and payment processing. When you register on this Site you are creating a GNetwork account. Matters relating to your GNetwork account and to payments, including billing, charges, subscriptions and renewals, saved payment methods, refunds, chargebacks, and payment disputes, are governed by the GNetwork Terms of Use. If these Terms conflict with the GNetwork Terms on any account or payment matter, the GNetwork Terms control.
You are responsible for keeping your login credentials confidential and for all activity under your account. Let us know right away if you believe your account has been used without your permission.
Dancing is a physical activity that carries an inherent risk of injury, including slips, falls, collisions, and strain. You participate voluntarily and at your own risk. You confirm that you are physically able to take part, and you agree to dance within your own limits, wear appropriate footwear, and stop if you feel unwell. Please consult a doctor before participating if you have any health concerns. You may be asked to sign a separate waiver before some events.
Misfit is a welcoming community. When attending events or using the Site, you agree to:
We may remove anyone from an event, or suspend or close an account, for violating this Code of Conduct.
Our events may be photographed or filmed. By attending, you agree that Misfit may use photos and video in which you appear on the Site, social media, and promotional materials, without payment to you. If you would prefer not to be featured, let a staff member know at the event or contact us and we will make reasonable efforts to accommodate you.
You may upload a profile picture to your account. You must own the rights to any image you upload, and it must be an appropriate picture of you. You grant Misfit a non-exclusive, royalty-free license to display it in connection with the Services. When you RSVP or buy a ticket for an event, your name and profile picture may appear on that event's guest list, which is visible to other signed-in members. We may remove any image that violates these Terms.
The Site and its content, including the Misfit Country Dancing name and logo, text, graphics, photos, video, and choreography materials, are owned by Misfit or its licensors. You may not copy, reproduce, or use them for commercial purposes without our written permission. Recording classes for your own personal practice is allowed only with the instructor's permission.
The Site relies on or links to services run by others, including GNetwork, Stripe, Google Maps, Instagram, and embedded music players. We are not responsible for third-party services, and your use of them is governed by their own terms and policies.
The Site and Services are provided "as is" and "as available," without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not guarantee that the Site will always be available, error-free, or secure.
To the fullest extent permitted by law, Misfit, its owners, instructors, and staff will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any personal injury or property loss arising from your participation in the Services, except where caused by our gross negligence or willful misconduct. Our total liability for any claim relating to the Services will not exceed the amount you paid to Misfit for the specific class or event giving rise to the claim.
You agree to indemnify and hold harmless Misfit, its owners, instructors, and staff from any claims, losses, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms or your conduct at our events.
We may suspend or end your access to the Services at any time if you violate these Terms. You may stop using the Services at any time. Closing your GNetwork account is handled under the GNetwork Terms.
These Terms are governed by the laws of the State of Montana, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Missoula County, Montana.
We may update these Terms from time to time. When we do, we will change the "Last updated" date above. Continuing to use the Services after an update means you accept the revised Terms.
